These Terms & Conditions (“Terms”) govern your use of all products, services, websites, mobile applications, digital content, and related materials provided by Crosstoner, LLC (“Crosstoner,” “we,” “our,” or “us”). By accessing or using any Crosstoner website, app, instructional content, or physical fitness products, you agree to be bound by these Terms. If you do not agree, you may not access or use any Crosstoner Services or Products.
Description of Services
Crosstoner provides a website, mobile application, digital exercise content, support documentation, user manuals, educational materials, and other online resources (“Services”). These Services allow users to access exercise demonstrations, training guidance, product information, account features, and other content. The Services are intended solely for personal, non-commercial use.
Product Manual & Safety Notices
All Crosstoner Products must be used in full accordance with the official Crosstoner User Manual, safety notices, warnings, and instructions (“Product Documentation”). The Product Documentation is incorporated into these Terms by reference. Your use of any Crosstoner Product signifies your agreement to follow all safety requirements as described in the manual and related documentation.

Use of Crosstoner Products
You agree to use Crosstoner Products only as instructed and only for their intended purpose. Proper use requires reading and understanding all Product Documentation before use; performing a visual inspection of the device and resistance bands before each session; avoiding finger placement near pinch points or rotating joints; using only Crosstoner-branded bands and accessories; ceasing use immediately if damage, wear, or irregular motion is observed; and keeping children and bystanders clear during operation.
No Medical Advice
All exercise content, demonstrations, and information provided through the Services are for general fitness and educational purposes only. Crosstoner does not provide medical, physical therapy, or rehabilitation advice. You should consult a physician before beginning any exercise program, especially if you have existing health conditions, injuries, or concerns. You assume full responsibility for evaluating your own health and determining whether the Products and Services are appropriate for you.
Assumption of Risk
Using fitness equipment involves inherent risks, including the risk of personal injury. By using Crosstoner Products or following any digital fitness content, you acknowledge and voluntarily assume all risks associated with physical activity, exercise equipment, resistance bands, dynamic force loads, and any interactions involving the Crosstoner device and its rotating components. You agree that you, and not Crosstoner, are responsible for your use of the Products and Services, including any injuries or damages resulting from misuse, failure to follow safety instructions, or failure to evaluate your own physical condition.
Account Registration
To access certain features, you may be required to create an account. You agree to provide accurate information, maintain the confidentiality of your login credentials, and accept responsibility for all activity conducted through your account. Crosstoner may suspend or terminate accounts that violate these Terms or are used fraudulently.
User Content
Certain parts of the Services may allow you to submit reviews, photos, videos, exercise logs, form-check media, or other content (“User Content”). By submitting User Content, you represent that you own or have appropriate rights to that content and that it does not violate any third-party rights or applicable laws.
You grant Crosstoner a worldwide, royalty-free, transferable, sublicensable license to host, store, display, reproduce, modify, and distribute your User Content for the purpose of operating, improving, marketing, and promoting the Services. Crosstoner may remove User Content at any time for violation of these Terms or for any reason deemed appropriate.
Prohibited Conduct
You agree that you will not:
• use the Services or Products for unlawful, harmful, or fraudulent activities;
• attempt to access accounts or systems without authorization;
• interfere with, disrupt, or compromise the security or performance of the Services;
• reverse-engineer or attempt to extract source code from the website, app, or Product firmware;
• upload or share harmful, infringing, or misleading User Content;
• use automated scripts or scraping tools without written permission;
• use the Products for commercial, instructional, rental, or institutional purposes without Crosstoner’s written consent.
Intellectual Property
All trademarks, product designs, instructional videos, photography, graphics, software, and other materials provided through the Services and Products are owned by Crosstoner or its licensors. You may access this content solely for personal use. Copying, distributing, modifying, or creating derivative works without authorization is prohibited.
Software, Firmware, and Updates
Crosstoner may update, modify, or discontinue aspects of the Services or Product firmware at any time. These updates may modify functionality, features, or performance. Continued use of the Services or Products after any update constitutes acceptance of the updated functionality.
Warranty Information
Crosstoner’s product warranty is provided separately from these Terms. The Terms do not describe or modify any product warranty. The current Crosstoner Warranty is available at:

Third-Party Platforms
If you download the Crosstoner mobile app through the Apple App Store or Google Play Store, your use of the app must also comply with the applicable platform’s terms and conditions. Crosstoner is not responsible for the availability, performance, policies, or security of any third-party platform.
Disclaimer of Warranties
Except for the separate written product warranty referenced above, all Services and digital content are provided on an “as is” and “as available” basis. Crosstoner disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Crosstoner does not guarantee the accuracy, reliability, or completeness of exercise content or other information provided through the Services.
Limitation of Liability
To the fullest extent permitted by law, Crosstoner and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including personal injury, property damage, lost data, or loss of profits arising from the use or inability to use the Products or Services. Crosstoner’s total liability for any claim shall not exceed the amount you paid for the Product or Service giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless Crosstoner and its affiliates from and against any claims, damages, liabilities, losses, or expenses (including reasonable legal fees) arising out of your use of the Products or Services, your violation of these Terms, or your violation of any rights of another party.
Class Action Waiver
To the maximum extent permitted by law, you and Crosstoner agree that any disputes shall be resolved on an individual basis, and neither party may bring or participate in any class, collective, or representative action.
Changes to the Terms
Crosstoner may update these Terms from time to time. When we do, we will revise the “Effective Date” at the top of this page. Continued use of the Services or Products after changes are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Products or Services shall be brought exclusively in the state or federal courts located in Baldwin County, Alabama.
Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will remain in full force and effect.
